These Terms of Service ("Terms") form a legally binding agreement between you and Lumin Marketing Group ("Lumin," "PKTD," "Pocketed," "we," "us," or "our") governing your use of the PKTD website, waitlist, iOS application, and related services.
1. Acceptance of Terms
By downloading, installing, accessing, or using PKTD, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
2. Description of the Service
PKTD is a receipt scanning and expense tracking product that includes website, waitlist, and iOS app experiences.
2.1 Core app features
- Receipt capture and import. You can capture receipts with your camera or import images from your photo library.
- On-device OCR. PKTD uses Apple frameworks to extract text from receipts on your device.
- Optional AI parsing. If you enable AI processing, extracted receipt text may be sent through our backend to OpenAI to structure and categorize the receipt.
- AI assistant. PKTD includes an AI chat assistant that can answer questions using the spending context generated from your app data.
- Expense and export tools. PKTD includes local receipt management, budgeting, trends, reports, and export features.
- Mileage tracking. PKTD includes mileage tracking that can use precise and background location when you choose to use that feature and grant permission.
- Referral and promo features. PKTD may generate device-linked referral codes and process promo code redemption.
2.2 Storage model
PKTD is designed so that receipt and spending data live primarily on your device. Some related service functionality still relies on backend infrastructure, including AI request handling, device-linked rate limiting, referral and promo records, waitlist operations, and limited service analytics. In addition, PKTD may use Apple's iCloud / CloudKit sync where available.
2.3 Website and waitlist
The PKTD website may allow you to join a waitlist, view marketing content, and access legal documentation. Waitlist functionality may rely on third-party providers.
3. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use PKTD.
4. Accounts, Device IDs, and Access
PKTD does not currently require a traditional username-and-password account for core app usage. However, some service features rely on a device-generated identifier and security headers to process AI requests, enforce usage limits, manage referrals and promo codes, and handle deletion requests.
You are responsible for maintaining control of your device and any Apple account used with the app, including iCloud sync and App Store purchases.
5. Subscriptions and Billing
Some PKTD features may require a paid subscription after any offered trial period. Subscription plans, pricing, billing periods, and renewal terms shown in the app or the Apple App Store at the time of purchase control.
- Payments are processed by Apple through your Apple ID.
- Subscriptions may auto-renew unless cancelled through Apple before renewal.
- Refunds are handled under Apple's policies unless applicable law requires otherwise.
6. AI Features and Important Disclaimers
6.1 How AI features work
- Receipt images are processed on-device for OCR.
- If AI parsing is enabled, the app sends extracted receipt text, not the image itself, to our backend for processing through OpenAI.
- If you use the AI assistant, your prompts and app-generated spending context are sent through our backend to OpenAI.
6.2 Your responsibility
You are solely responsible for reviewing, validating, and correcting any output generated by PKTD before relying on it for budgeting, bookkeeping, taxes, reimbursements, or other decisions.
6.3 AI training
We do not currently use your receipt data or AI chat content to train PKTD models. OpenAI API content is not used by OpenAI to train their models under OpenAI's API terms.
7. Location, Mileage, and Permissions
If you use mileage tracking, PKTD may request precise location access, including background location, to track trips while you drive. If you do not grant location permission, mileage features may not work correctly or at all.
PKTD may also geocode merchant addresses found on receipts to create map coordinates for receipt records and insights.
8. Acceptable Use
You agree not to:
- use PKTD for unlawful, fraudulent, or abusive purposes,
- attempt to reverse engineer, disrupt, or interfere with the app or our backend systems,
- circumvent usage limits, subscriptions, security, or anti-abuse controls,
- upload or transmit malicious code, or
- use PKTD to build or train a competing service using our product, prompts, or outputs in a way that violates applicable law or these Terms.
9. Your Content
You retain ownership of the content you provide to PKTD, including receipt images, receipt text, notes, budgets, and trip information.
You grant us a limited, non-exclusive right to host, transmit, process, transform, and display that content only as needed to operate PKTD, including AI processing, exports, sync through Apple services where enabled, waitlist processing, and deletion workflows.
10. Our Intellectual Property
PKTD, Pocketed, our branding, interfaces, code, documentation, and related materials are owned by Lumin Marketing Group or our licensors and are protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use PKTD for your internal personal or business expense tracking purposes in accordance with these Terms.
11. Privacy
Your use of PKTD is also governed by our Privacy Policy. In summary:
- receipt and spending data are primarily stored locally on your device,
- some features use backend services and device-linked operational records,
- AI features send text data to OpenAI only when those features are used,
- mileage tracking can use precise and background location, and
- we do not sell your personal information or use it for cross-context behavioral advertising.
12. Termination and Data Deletion
You may stop using PKTD at any time. You may also use in-app deletion features to delete local data and request associated backend cleanup for supported device-linked records.
We may suspend or terminate access to online service components if you violate these Terms, create legal risk, or abuse the service.
13. Disclaimers
- PKTD is provided on an "as is" and "as available" basis to the maximum extent permitted by law.
- We do not guarantee uninterrupted availability, error-free operation, perfect OCR, perfect AI output, or perfect location accuracy.
- Third-party services such as Apple, OpenAI, Beehiiv, GoHighLevel, Resend, Slack, and Cloudflare may affect the availability or performance of parts of PKTD.
14. Limitation of Liability
To the maximum extent permitted by law, Lumin Marketing Group and its affiliates, officers, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, tax benefits, reimbursement opportunities, or business opportunities arising from or related to your use of PKTD.
To the maximum extent permitted by law, our total liability for claims arising out of or relating to PKTD will not exceed the greater of the amounts you paid us for PKTD in the 12 months before the claim arose or CAD $100.
15. Indemnification
You agree to defend, indemnify, and hold harmless Lumin Marketing Group and its affiliates, officers, employees, contractors, and licensors from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of PKTD, your content, or your violation of these Terms or applicable law.
16. Changes to These Terms
We may update these Terms from time to time. If we make a material change, we may provide notice through the app, website, or email where appropriate. Your continued use of PKTD after the updated Terms become effective means you accept them.
17. Governing Law
These Terms are governed by the laws of Alberta and the applicable federal laws of Canada, without regard to conflict of law rules, except where mandatory local law requires otherwise.
18. Apple Addendum
If you access PKTD through an Apple device, you acknowledge that these Terms are between you and Lumin Marketing Group, not Apple. Apple has no obligation to furnish maintenance or support services for PKTD except as required by law. Apple and its subsidiaries are third-party beneficiaries of these Terms to the extent applicable to the iOS app.
